2. Eligibility Requirements

To use ChatTuber.ai, you must meet the following requirements:

• Minimum Age: You must be at least 13 years old to use the Service
• EU/UK Users: If you reside in the European Union or United Kingdom, you must be at least 16 years old
• Parental Consent: Users under 18 must have parental or guardian consent to use the Service
• Legal Capacity: You must have the legal capacity to enter into a binding agreement in your jurisdiction

3. User Responsibilities

By using ChatTuber.ai, you acknowledge and agree to the following:

4. Prohibited Uses

You agree NOT to use ChatTuber.ai for any of the following purposes:

• Impersonating real creators for fraudulent purposes
• Using AI-generated content to deceive others into believing they are communicating with real individuals
• Spreading misinformation attributed to real creators

4.2 Harmful Content

• Generating content that promotes violence, self-harm, or illegal activities
• Creating sexually explicit, obscene, or pornographic content
• Producing content that exploits or endangers minors
• Generating hate speech or content that discriminates based on protected characteristics

4.3 Harassment and Abuse

• Harassing, bullying, or intimidating any individual
• Defaming or making false statements about real individuals
• Stalking or engaging in unwanted contact
• Threatening violence or harm against any person

4.4 Privacy Violations

• Attempting to extract personal, private, or confidential information about creators
• Sharing private information about any individual without consent
• Using the Service to gather intelligence on real individuals

4.5 Service Abuse

• Circumventing usage limits, rate limits, or technical restrictions
• Reverse engineering, decompiling, or attempting to access source code
• Using automated tools, bots, or scripts to access the Service
• Interfering with or disrupting the Service or servers

4.6 Commercial Misuse

• Reselling, redistributing, or licensing access to the Service

5.2 Parody and Fair Use

Our AI-generated content constitutes transformative parody protected under fair use principles. Specifically:

• Transformative Use: Our AI creates original, transformative content that comments on and parodies public personas, not reproductions of copyrighted material
• Public Information Only: AI personalities are built solely from analysis of publicly available content and communication patterns
• Original Output: All generated responses are original AI creations, not copies of existing content
• No Direct Reproduction: We do not reproduce copyrighted works, scripts, or protected content

5.3 User Content

You retain ownership of content you create while using the Service. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your inputs solely for the purpose of providing the Service.

6. Creator Rights and Takedown Process

We respect content creators and provide a clear process for addressing concerns about AI representations.

6.1 Takedown Requests

Content creators (or their authorized representatives) may request removal of AI personalities inspired by their communication styles. To submit a request:

• Visit our Creator Takedown page
• Provide verification of your identity as the creator or authorized representative
• Specify the AI personality you wish to have removed

6.2 Response Timeline

We commit to the following response times:

• Acknowledgment: Within 24 hours of receiving a valid request
• Verification: Identity verification completed within 48 hours
• Removal: Content removed within 48 hours of verification

6.3 Appeal Process

If a takedown request is denied, the requesting party may appeal the decision by providing additional documentation or clarification. Appeals will be reviewed by our legal team within 5 business days.

8.3 Limitation of Damages

IN NO EVENT SHALL CHATTUBER.AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in subscription fees during the twelve (12) months prior to the claim.

9. Subscription Terms

9.1 Billing Cycles

Subscriptions are billed in advance on a recurring basis according to your chosen billing cycle (monthly or annually). Your subscription begins on the date of your first payment.

9.2 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You authorize us to charge your payment method on file for the applicable subscription fee.

9.3 Cancellation Policy

You may cancel your subscription at any time through your account settings. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• You will not be charged for the next billing cycle
• No partial refunds will be provided for unused time in the current period

9.4 Price Changes

We reserve the right to modify subscription prices at any time. We will provide at least 30 days advance notice of any price increases. Price changes will take effect at the start of your next billing cycle following the notice.
